Court Rules Trump Can Maintain Control of California National Guard


Los Angeles Mayor Karen Bass is urging the Trump administration to halt immigration raids, citing their potential to escalate protests in the city. Concurrently, a U.S. appeals court has granted Trump the authority to retain control over California’s National Guard while Democratic Governor Gavin Newsom challenges the legality of this federal intervention amidst civil unrest.

On June 19, a three-judge panel from the 9th U.S. Circuit Court of Appeals upheld a temporary pause on a previous ruling by U.S. District Judge Charles Breyer. Breyer had determined that Trump unlawfully federalized the National Guard without coordinating with Newsom, finding no justification under U.S. law for such action. Following Breyer’s ruling, which aimed to return control of the National Guard to the state, the court issued a stay on his decision.

Trump had mobilized 4,000 National Guard troops against the backdrop of protests linked to his immigration policies, and subsequently ordered 700 U.S. Marines to Los Angeles. The legality of the Marine deployment is still under review.

During recent court hearings, the 9th Circuit judges examined the scope of the judiciary’s role concerning presidential military deployments, especially regarding national emergencies. The Trump administration claims that it is not engaging in law enforcement but rather protecting federal entities, including ICE.

California argues that Trump’s actions undermine state sovereignty and that the protests, characterized by sporadic violence, do not equate to a rebellion requiring military intervention. The ongoing dialogue reflects broader national tensions regarding the military’s role on domestic soil, with public protests in Los Angeles having ratcheted down after a week, prompting Bass to lift a previously imposed curfew.
