Trump seeks dismissal of Georgia criminal case citing election victory


President-elect Donald Trump is seeking to have an election racketeering case against him in Georgia dismissed on constitutional grounds as he prepares to return to the White House. His lawyer has asked the Court of Appeals to order the charges be dropped because of his pending presidency and argues that the U.S. Constitution mandates the dismissal of any ongoing criminal proceedings against a sitting president. The Appeals Court had already canceled a hearing where Trump’s lawyer planned to argue for the removal of the district attorney due to a conflict of interest.

In a related case, Trump’s legal team has also requested for the dismissal of 34 counts of falsifying business records in Manhattan, citing Trump’s impending return to office. The president-elect’s lawyers argue that neither the Appeals Court nor a Georgia trial court has the jurisdiction to oversee further criminal processes against Trump based on his incoming presidency. This move follows federal judges dismissing cases against Trump for allegedly trying to steal the 2020 election and mishandling national defense documents after leaving the White House. The Justice Department special counsel requested the dismissals in line with a policy that bars the prosecution of sitting presidents. Trump’s legal team is pushing for the dismissal of all pending cases against him in light of his upcoming presidency.
