In a historic decision, the International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas military leader Mohammed Deif for alleged war crimes related to the Gaza war. This marks the first time that leaders of a democracy and western-aligned state have been charged by the court in its 22-year history.
The warrants state that there are reasonable grounds to believe that Netanyahu and Gallant are responsible for the war crime of starvation as a method of warfare, as well as crimes against humanity including murder and persecution. Deif, on the other hand, is believed to be responsible for crimes such as murder, torture, rape, and hostage-taking in relation to a Hamas attack in 2023.
The ICC’s decision has been met with strong opposition from Israel, with Netanyahu’s office denouncing it as antisemitic and biased. The United States, while rejecting the court’s decision, has expressed concerns over the rush to seek arrest warrants and process errors.
Human rights groups have welcomed the warrants, stating that they send a message that no one is beyond the reach of the law. The ICC emphasized that it had jurisdiction to investigate crimes on Palestinian territory without Israeli approval.
The arrest warrants come at a critical time as the US seeks to broker a ceasefire between Israel and Hamas. The warrants could increase external pressure on Netanyahu’s government while potentially strengthening his political position in the short term due to most Israelis rejecting the ICC’s jurisdiction. The ICC prosecutor, Karim Khan, is facing allegations of sexual misconduct, further adding to the complexity of the situation.
